Discovery / Employee Depositions

BSP’s robust discovery practice ranges from the early stages of discovery to the preparation and defense of company witness depositions. Our deep experience and skill in all aspects of the discovery process allows us to successfully and efficiently defend our clients. A differentiating capability for BSP is our ability to prepare witnesses who represent the company in 30(b)(6) or similar depositions. Because such depositions are now a mainstay of civil litigation, BSP has developed a thorough and strategic approach to preparing witnesses for what is often the most important deposition in a case. BSP’s successful trial lawyers craft discovery responses with the jury in mind, while protecting our clients’ sensitive and privileged materials.

BSP Has Extensive Experience With:

  • Meet and Confer Conferences
  • Protective Orders
  • Forensic Analysis
  • Claw Back Agreements

Counseling and Trainings on Compliance and Best Practices Include:

  • Information Management
  • Data Destruction Policies
  • Litigation Holds
  • Spoliation Prevention
  • Assessment of Current Capabilities
  • Cost Considerations
  • Proportionality (Cost & Scope)
  • Government Inquiries and Subpoenas

The Litigation Support Team represents companies in cases requiring both extensive electronic and paper discovery. We supplement our core in-house team with vendor partners to provide technology and flexible staffing on a case-by-case basis. With a focus on cost and quality control, our team manages Early Case Assessment (ECA) of Large Data Collections; Document Processing and Searching; and Computer Assisted Review (CAR) or Eyes-On Document Review, as appropriate. For document review, we recommend technology and tools to ensure quality and to afford economies-of-scale pricing. Being “tool agnostic,” we choose what best suits our clients’ needs, not ours.
