BSP Secures Denial of New Trial in Consumer-Leasing Action

UPDATE: On behalf of Ford Motor Credit Company LLC, BSP attorneys Patrick Seyferth, Susan McKeever, and Justin Weiner obtained denial of a new trial motion, securing the complete defense jury verdict the trio had obtained in November 2019.  Rejecting the Plaintiff’s claim that the evidence compelled a verdict in his favor, Judge Daniel Gaul ruled that “the jury relied on substantial, credible evidence to support the verdict.”  Based on post-trial briefing from BSP, Judge Gaul also rejected all of the plaintiff’s many procedural challenges to the verdict.

BSP Secures Defense Verdict in Consumer-Leasing Action

On behalf of Ford Motor Credit Company LLC, BSP attorneys Patrick Seyferth, Justin Weiner, and Susan McKeever secured a defense verdict following a jury trial in Cuyahoga County, Ohio. The plaintiff, a former lessee, alleged that Ford Credit had overcharged him for “Excess Wear and Use” when he returned his vehicle.  He brought one claim for fraud and another for a violation of the Consumer Leasing Act, and he sought emotional-distress damages, attorneys’ fees, and punitive damages.  After a week-long, vigorously-contested trial, the jury deliberated for just over two hours, and found in favor of Ford Credit on both counts.
