BSP Wins Dismissal of an Action for No-Fault PIP Benefits

Representing Repwest Insurance Company, BSP attorneys Moheeb H. Murray and Luis E. Gomez won dismissal of an action for No-Fault PIP benefits pending in the Wayne County Circuit Court.  The lawsuit, filed by a medical testing facility, sought payment on assignment for drug screens the facility allegedly provided the insured.  The Circuit Court held that neither the insured nor the testing facility provided Repwest with proper notice of a claim assignment, so Repwest’s good-faith settlement and payment to the insured discharged Repwest’s liability.
